These Terms and Conditions apply to lessons, lesson packages, consultations, courses and other educational services provided by Ádám Eszter / Hungarian with Eszter through this website or otherwise booked directly with the Teacher.

By booking or purchasing a paid service, the Customer confirms that they have read and accepted these Terms and Conditions.

1. Service Provider

The services are provided by:

Ádám Eszter
1064 Budapest
Rózsa utca 78
Hungary
Email: hungarianwitheszter@gmail.com

Further business information is available in the Legal Notice on this website.

For the purposes of these Terms and Conditions, Ádám Eszter / Hungarian with Eszter is referred to as the “Teacher” or “Service Provider”, and the person purchasing or booking the service is referred to as the “Customer” or “Student”.

2. Scope of the Services

The Teacher provides Hungarian language teaching and related educational services, which may include:

  • online private lessons;
  • in-person private lessons;
  • introductory consultations;
  • lesson packages;
  • cultural and conversational activities; and
  • other Hungarian-language educational services described on the website.

The availability, format, duration, price, location and content of individual services may vary.

The description and price displayed for a service at the time of booking form part of the agreement between the Customer and the Teacher.

3. Free Initial Consultation

Where offered, the Teacher may provide one free initial consultation for a new Student.

The purpose of the consultation is to discuss the Student’s current language level, learning goals, preferred lesson format and other relevant learning needs.

A free consultation does not create an obligation to purchase paid lessons.

Unless expressly stated otherwise, the free consultation has no monetary value and cannot be exchanged for cash or transferred to another person.

4. Booking and Formation of the Contract

Lessons and lesson packages may be booked through the online booking system on this website or arranged directly with the Teacher where applicable.

When a Customer submits a booking or purchase through the website, the Customer is responsible for checking that all information entered is correct before completing the booking.

A binding contract is formed when the booking or purchase has been accepted and confirmed by the Teacher or by the booking system on the Teacher’s behalf.

For paid services, confirmation may also be conditional upon successful payment.

The Customer will normally receive an electronic confirmation of the booking.

The Teacher reserves the right to reject or cancel a booking where there is a legitimate reason to do so, including an obvious pricing or technical error, duplicate booking, lack of availability or circumstances that prevent the Teacher from providing the requested service. Any amount already paid for a service cancelled for such a reason will be refunded unless the Customer agrees to an alternative arrangement.

5. Lesson Format and Duration

Lessons may be provided online or in person, depending on the service selected.

Private lessons are normally offered in durations stated on the relevant booking page, including 60-minute and 90-minute lessons where available.

The format and location of the lesson are stated during booking or agreed directly with the Teacher.

Online lessons are normally conducted using the video-conferencing platform specified by the Teacher.

6. Lesson Packages

Where lessons are sold as a package, the number of lessons, duration of each lesson and total package price are stated before purchase.

Unless otherwise stated:

  • a 5-lesson package must be used within 3 months of purchase; and
  • a 10-lesson package must be used within 6 months of purchase.

The validity period begins on the date the package is purchased unless another starting date has been expressly agreed.

Students are responsible for booking and using their lessons within the applicable validity period.

Unused lessons expire at the end of the validity period unless otherwise required by applicable law or an extension has been expressly agreed by the Teacher.

The Teacher may grant an extension in exceptional circumstances at her discretion.

Lesson packages are personal to the Student and may not be transferred, resold or shared with another person without prior agreement from the Teacher, except where the service has specifically been purchased for multiple students.

7. Prices

The applicable price is the price displayed to the Customer before the booking or purchase is completed.

Prices are shown in the currency indicated during booking.

Any taxes that are required to be included in the consumer price will be included or clearly indicated as required by applicable law.

The Teacher may change prices for future bookings at any time. A price change does not affect a package or service that has already been purchased and confirmed.

Any promotional price or discount is subject to the conditions stated together with that promotion.

8. Payment

Unless otherwise stated, paid lessons and lesson packages must be paid in advance.

Available payment methods are displayed during checkout and may include payment services provided by third-party payment providers such as PayPal or Stripe.

The Teacher does not receive or store the Customer’s full payment-card details where payment is processed directly by an external payment provider.

A booking may remain unconfirmed until the required payment has been successfully completed.

If payment is cancelled, rejected, reversed or otherwise not received, the Teacher is not obliged to provide the booked paid service.

Where required, receipts or invoices will be issued in accordance with applicable Hungarian tax and accounting requirements.

9. Scheduling and Rescheduling

Students may book available lesson times through the booking system where online scheduling is available.

The availability shown in the booking system may change.

A confirmed lesson may be rescheduled subject to the cancellation and rescheduling rules below.

Students should arrive or connect at the scheduled start time.

If a Student arrives late, the lesson will normally still end at the originally scheduled end time, and the lost time will not normally be added to the lesson.

10. Cancellation by the Student

A Student may cancel or reschedule a lesson without losing the lesson if the cancellation is made at least 24 hours before the scheduled starting time, unless different conditions were clearly stated for the particular service before booking.

If a Student:

  • cancels less than 24 hours before the lesson;
  • fails to attend;
  • is unavailable at the scheduled time; or
  • is sufficiently late that the lesson cannot reasonably be conducted,

the lesson may be treated as provided and deducted from the Student’s package or charged in full.

This 24-hour cancellation policy relates to scheduled lessons and is separate from any statutory consumer right of withdrawal described in Section 14.

The Teacher may make exceptions in exceptional circumstances at her discretion.

11. Cancellation or Rescheduling by the Teacher

If the Teacher has to cancel a lesson, the Student will not lose that lesson.

The lesson will normally be rescheduled to another mutually suitable time.

If the Teacher is unable to provide a prepaid service and no reasonable alternative can be agreed, the Student will receive a refund for the affected prepaid service or unused lesson, as applicable.

The Teacher is not responsible for reasonable changes caused by circumstances outside her control, but will make reasonable efforts to minimise disruption.

12. Online Lessons and Technical Requirements

For online lessons, the Student is responsible for having:

  • a suitable internet connection;
  • a compatible computer, tablet or other device;
  • working audio equipment;
  • a camera where required or appropriate; and
  • access to the relevant video-conferencing service.

The Student should test their equipment before the lesson where necessary.

If a lesson cannot reasonably take place because of a technical problem on the Student’s side, this may be treated in the same way as a late cancellation or missed lesson.

If a substantial technical problem occurs on the Teacher’s side and prevents the lesson from being provided, the affected lesson will be rescheduled or otherwise credited to the Student.

Where technical problems affect only part of a lesson, the Teacher and Student will attempt to find a reasonable solution based on the circumstances.

13. Learning Results

Language learning depends on many factors, including the Student’s starting level, attendance, practice, study habits and individual learning ability.

The Teacher will provide the educational service with reasonable professional care but cannot guarantee that a Student will reach a particular language level, pass an examination, obtain citizenship, obtain employment or achieve any other particular result.

Any materials relating to citizenship preparation are educational in nature and do not constitute legal or immigration advice.

14. Consumer Right of Withdrawal

This section applies where the Customer is a consumer and enters into a distance contract, for example by purchasing a service online.

14.1 14-day withdrawal period

Subject to the exceptions provided by law, a consumer has the right to withdraw from a distance service contract within 14 days from the date the contract is concluded, without giving a reason.

To exercise this right, the Customer must inform the Teacher of the decision to withdraw through the withdrawal function made available on the website or by another clear statement where permitted by applicable law.

The withdrawal must be submitted before the withdrawal period expires.

14.2 Lessons beginning during the withdrawal period

A Customer may wish to begin using a lesson or lesson package before the 14-day withdrawal period has expired.

Where required by law, the Teacher will obtain the Customer’s express request for performance of the service to begin during the withdrawal period.

If the Customer requests that the service begins during the withdrawal period and subsequently exercises the statutory right of withdrawal before the service has been fully performed, the Customer may be required to pay an amount proportionate to the services already provided up to the time the Teacher is informed of the withdrawal.

For a lesson package, this may include lessons already provided before the withdrawal request.

14.3 Completed services

Where a paid service has been fully performed during the withdrawal period, the Customer may lose the statutory right of withdrawal if:

  1. performance began with the Customer’s prior express request or consent as required by law; and
  2. the Customer acknowledged that the right of withdrawal would be lost once the service had been fully performed.

14.4 Refund following statutory withdrawal

Where a valid statutory withdrawal applies, amounts due to be refunded will be refunded without undue delay and within the period required by applicable law.

Where part of the service has already been provided at the Customer’s express request during the withdrawal period, the Teacher may deduct the proportionate amount payable for the service already provided where permitted by law.

Statutory withdrawal rights are separate from the ordinary lesson cancellation and rescheduling rules set out in Section 10.

Nothing in these Terms and Conditions limits any mandatory consumer right that cannot legally be excluded or restricted.

15. Refunds Outside the Statutory Withdrawal Right

Except where required by law or expressly stated in these Terms and Conditions, purchased lesson packages are not refundable merely because the Student changes their plans or decides not to continue taking lessons.

However, the Teacher may agree to a refund or other solution in exceptional circumstances.

Any statutory rights available to consumers remain unaffected.

16. Educational Materials and Intellectual Property

Lesson plans, worksheets, exercises, presentations, recordings, documents and other teaching materials created or provided by the Teacher may be protected by copyright and other intellectual property rights.

Unless otherwise stated, materials supplied to a Student are for that Student’s personal, non-commercial educational use.

Students may not reproduce, publish, sell, distribute, upload or otherwise make the Teacher’s materials available to third parties without permission, except where permitted by law.

The Student may retain materials supplied for personal study unless otherwise stated.

17. Recording of Lessons

Students may not record audio or video of a lesson without the Teacher’s prior permission.

The Teacher will not record a lesson involving a Student without informing the Student and obtaining any consent required by applicable law.

Separate arrangements may apply where a course is expressly marketed as including recordings.

18. Student Conduct

Students are expected to communicate and behave respectfully.

The Teacher may refuse or discontinue services where a Student engages in harassment, threats, abusive behaviour, serious disruption, unlawful conduct or conduct that makes continuation of the teaching relationship unreasonable.

Where services are discontinued for serious misconduct by the Student, the treatment of unused prepaid lessons will depend on the circumstances and applicable law.

19. Personal Data

Personal data collected in connection with bookings, payments, customer accounts, communication and lessons is processed in accordance with the Privacy Policy available on this website.

Cookies and similar technologies are described separately in the Cookie Policy.

Third-party services used for booking, payment, communications or online lessons may process personal data in accordance with their own terms and privacy policies.

20. Third-Party Services

The website and teaching services may rely on third-party services such as booking systems, payment providers, video-conferencing providers, hosting providers and communication platforms.

The Teacher is not responsible for temporary interruptions or failures of an independent third-party service that are outside her reasonable control.

This does not affect any statutory rights that the Customer may have against the Teacher.

21. Availability of the Website and Booking System

The Teacher aims to keep the website and booking system available but cannot guarantee uninterrupted or error-free access.

The website or booking system may occasionally be unavailable due to maintenance, technical errors, updates or circumstances outside the Teacher’s control.

If a technical error results in an incorrect booking, availability or price, the Teacher will contact the affected Customer and attempt to resolve the issue.

22. Complaints

If a Customer is dissatisfied with a service, booking or payment, the Customer should first contact the Teacher:

Ádám Eszter / Hungarian with Eszter
Email: hungarianwitheszter@gmail.com

The Customer should provide sufficient information to identify the booking and explain the complaint.

The Teacher will handle consumer complaints in accordance with applicable Hungarian consumer-protection requirements and will attempt to resolve disputes directly wherever possible.

23. Alternative Consumer Dispute Resolution

If a consumer dispute cannot be resolved directly between the Customer and the Teacher, the consumer may be entitled to refer the matter to a Hungarian conciliation body (békéltető testület) for alternative dispute resolution.

The conciliation body associated with the Service Provider’s registered location is:

Budapest Conciliation Board
(Budapesti Békéltető Testület)

Address:
1016 Budapest, Krisztina krt. 99.
Hungary

Postal address:
1253 Budapest, Pf. 10.
Hungary

Email: bekelteto.testulet@bkik.hu

Consumers may contact the Budapest Conciliation Board for information about the applicable procedure and the submission of a consumer dispute.

Before initiating conciliation proceedings, the consumer must first attempt to resolve the complaint directly with the Service Provider as required by applicable law.

For cross-border consumer disputes within the European Union or European Economic Area, consumers may also seek information or assistance from the European Consumer Centre in their country of residence.

Participation in an alternative dispute-resolution procedure does not remove any right to seek remedies through the courts where applicable.

24. Liability

The Teacher is responsible for providing the agreed educational services in accordance with applicable law.

To the fullest extent permitted by law, the Teacher is not liable for losses caused solely by:

  • circumstances outside the Teacher’s reasonable control;
  • the Student’s own equipment or internet connection;
  • inaccurate information supplied by the Student;
  • the Student’s failure to attend or prepare for a lesson; or
  • interruption of an independent third-party service outside the Teacher’s reasonable control.

Nothing in these Terms and Conditions excludes or limits liability where such exclusion or limitation would be prohibited by law.

25. Force Majeure and Circumstances Outside Reasonable Control

Neither party will be responsible for a failure or delay caused by circumstances that could not reasonably have been prevented, including serious illness, accidents, widespread technical outages, natural disasters or other comparable events.

Where possible, the parties will attempt to reschedule the affected lesson or agree on another reasonable solution.

This provision does not remove any mandatory rights available to consumers under applicable law.

26. Changes to These Terms and Conditions

The Teacher may update these Terms and Conditions from time to time, for example because of changes to the services, booking system or applicable legal requirements.

The version applicable to a purchase is normally the version in effect when the relevant contract was concluded.

Material changes will not retrospectively remove rights already acquired under an existing contract.

The date of the latest revision appears at the top of this page.

27. Governing Law

These Terms and Conditions and contracts entered into with the Teacher are governed by Hungarian law, subject to any mandatory consumer-protection rights that apply to the Customer under the laws of their country of habitual residence.

Where the Customer is a consumer residing in another EU or EEA country, nothing in these Terms and Conditions deprives the Customer of mandatory consumer protections that apply under applicable law.

28. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
